User Agreement

1. Subject of the User Agreement

1. Placing an order through the website automatically constitutes an instruction from the Buyer to the Agent in accordance with the order and the current agreement.
2. The Agent has the right to engage any third parties, referred to as “companions”, for the purpose of performing the paid order and this agreement.
3. The name of the gaming services, their description, cost, payment methods, and other terms are specified on the Website on the relevant web page.

2. General Provisions

1. E-girlz may also receive Personal Information from its partners, hereinafter referred to as the “Partners”, whose websites, programs, products, or services you use, for example from E-girlz advertisers. In such cases, the transfer of Personal Information is only possible in the cases established by applicable law and is carried out on the basis of special agreements between E-girlz and each Partner.
2. Please note that the use of any of the Websites and/or Services may be governed by additional terms that may amend and/or supplement this Policy and/or contain special conditions relating to personal information, published in the relevant sections of the documents for such Websites and/or Services. Please also refer to our Cookie Policy .
3. When processing personal data, E-girlz is guided by international law and the laws of the EU, Russia, Ukraine, and Georgia. In particular, this policy follows the requirements of Federal Law No. 152-FZ dated July 27, 2006 “On Personal Data”, the Law of Ukraine “On Personal Data Protection”, the Law of Georgia “On Personal Data Protection”, and EU Regulation 2016/679 (GDPR).
4. If we make material changes to this Policy, we will inform you accordingly. E-girlz may also request your consent to continue processing personal data, even if you provided similar consent previously.
5. E-girlz welcomes your questions and suggestions concerning the implementation or amendment of this Policy. Please use our feedback form at https://egirlstime.com/support/ticket. You may also use this form, and the email address help@EgirlsTime.com, to submit requests regarding the exercise of your rights or complaints concerning the inaccuracy of your Personal Information or the unlawfulness of its processing.

3. Purposes of Personal Data Processing

1. Protecting your Personal Information and your privacy is extremely important to E-girlz. When you use E-girlz Websites and Services, we protect and process your Personal Information in strict accordance with applicable law. In line with our obligations to protect your Personal Information, this Policy aims to inform you as transparently as possible about the following matters.
2. Commercial information and orders. This includes any personal data that you provide to us and/or to other users of our Website when placing an order, replying to a message, accepting order terms, discussing transaction details, and/or taking other actions related to marketplace services and Website Services. 4. Data and content stored in E-girlz systems. Information about your activity while using the Websites and/or Services, including purchase data, service usage data, interaction with other users, and files and content stored in E-girlz systems, including your reviews on third-party websites and/or resources, comments about the quality of our Services and/or Website, and any data required for the proper review of complaints and the operation of the arbitration service.
5. Dispute resolution. Proper review of complaints and the correct operation of our arbitration service are essential to our ability to provide services. Therefore, we may require a certain set of personal data to fully examine your complaints or complaints that may concern you. E-girlz reserves the right to publish and/or use certain types of personal data that are necessary to protect its business reputation and brand reputation.
6. Technical data and analytics. For detailed analytics and collection of technical data, E-girlz uses a set of functions, including cookies, that may collect your personal data. E-girlz also uses third-party web analytics tools to collect information about traffic sources, website visits, and the effectiveness of our Services. Examples include Yandex.Metrica and Google Analytics. The personal data collected in this way may include the date and time of access to the Websites and/or Services, electronic data such as HTTP headers, IP address, cookies, browser identifier data, and software data.

8. Sensitive personal data. E-girlz does not intentionally collect sensitive personal information, such as racial origin, political opinions, health information, or biometric data, except where required by law.
9. The purposes of processing the User’s personal data include informing the User by sending emails, concluding, performing, and terminating civil law agreements, and providing the User with access to services, information, and/or materials available on the website.
10. The Operator also has the right to send the User notifications about new products and services, special offers, and various events. The User may always opt out of receiving informational messages by sending an email to help@EgirlsTime.com with the subject line “Opt-out of notifications about new products, services, and special offers”.
11. Anonymized User data collected through internet statistics services is used to gather information about user actions on the website and to improve the quality of the website and its content.

4. Who Else Has Access to Your Personal Information and to Whom It May Be Transferred

1. E-girlz may transfer your Personal Information to its employees within the limits provided by applicable law. E-girlz may also transfer your Personal Information to its affiliates, including third parties and services with which E-girlz cooperates. Please note that the level of Personal Information protection in some countries may differ from the level established in your jurisdiction, and by using our Services and/or Website you agree to such transfer. These third parties may include Yandex.Metrica, Google Analytics, Zendesk, Freshdesk, and Tome.
2. E-girlz may receive certain data from third parties that may be required under the law or for compliance with contractual obligations, for example your payment data such as a masked payment card number.
3. When processing data obtained in the manner described in clause 4.1, E-girlz is guided by international law and the laws of the EU, Russia, Ukraine, and Georgia.

5. Legal Basis and Purposes of Processing Your Personal Information

1. In addition to clause 3 of this Policy, E-girlz processes your Personal Information only where:
   • it is necessary to provide access to your account, including account settings and other Website tools;
   • processing is necessary for the performance of E-girlz contractual obligations to you, including operation of the Websites and Services;
   • processing is necessary to comply with legal obligations;
   • processing is necessary to improve the quality of our services and/or understand how you interact with our Websites and/or Services;
   • where permitted by applicable law, processing is necessary for E-girlz legitimate interests, provided that such processing does not materially affect or harm your interests, rights, and freedoms.
2. For specific purposes, or where required by applicable law, we may request your separate consent to process your Personal Information. In jurisdictions where consent is recognized as an independent legal basis, your use of the Websites and/or Services constitutes your consent to such processing.
3. We hereby inform you, and you confirm, that you are under no obligation to provide us with any Personal Information when using the Websites or Services, and such provision is based solely on your free will. At the same time, you understand that without providing Personal Information we may be unable to offer you the Services, and your use of the Websites may be limited.
4. E-girlz always processes your Personal Information for the purposes specified in this clause and only such Personal Information as is relevant to achieving those purposes.
5. From time to time, E-girlz may use technical solutions, tools, and services of third parties. These solutions, tools, and services may process your data for purposes different from those set out in this Policy. E-girlz is not responsible for the personal data processing practices of third parties. Nevertheless, we welcome your questions and suggestions regarding the processing of your data by third parties. 6. Rights and Obligations of the Parties

E-girlz undertakes to:

1. review and verify reasoned claims received from the Buyer within one month from receipt at help@EgirlsTime.com;
2. take all necessary actions to perform this agreement and the Buyer’s paid order;
3. maintain the operation of the website except where this is impossible for reasons beyond the Administration’s control;
4. provide comprehensive protection of the User’s account;
5. provide all available information about the User to competent state authorities in cases established by law.

E-girlz has the right to:

1. delete information from the Website without prior notice to the Buyer or third parties;
2. refuse to perform the Buyer’s order if there is no technical possibility to do so and issue a refund;
3. engage third parties to fulfill its obligations under this Offer;
4. request consent to the processing of personal data from website users at any time and in any form;
5. inform the Buyer about gaming services through informational mailings;
6. block and/or delete a performer’s account unilaterally, regardless of balance, if fraud or violations of this agreement are detected;
7. create, modify, or delete information, delete accounts, refuse registration without explanation, and change the pricing policy for goods or services at its own discretion and as necessary.

The Buyer must:

1. promptly notify the Website Administration of any service claims through the support section or by email at help@EgirlsTime.com;
2. pay the full cost of goods and/or services in accordance with this Offer;
3. independently and promptly review all information posted on the Website and in notifications sent to the Customer’s email address;
4. consent to receiving informational messages and notifications by email or personal messages;
5. update Personal Data provided during registration if it changes;
6. not copy information from other sources;
7. not distribute information aimed at war propaganda, incitement of national, racial, or religious hatred or hostility, or any other information whose distribution entails criminal or administrative liability;
8. not disrupt the operation of the website;
9. not take actions aimed at misleading other Users;
10. not transfer the use of their account and/or account login and password to third parties;
11. not register an account on behalf of or instead of another person except where permitted by Russian law;
12. not post advertising, erotic, pornographic, or offensive material, or any other information whose publication is prohibited or contradicts applicable Russian law;
13. not use scripts or programs for automated collection of information and/or interaction with the Website and its Services.

The Companion must:

1. accept that registration on the website as a “Companion” (e-girl) and use of the E-girlz service means full acceptance of this User Agreement;
2. properly perform the services paid for by the Buyer;
3. follow the procedure and regulations for service provision established by the Agent;
4. update Personal Data provided during registration if it changes;
5. not copy information posted in the blog section from other sources;
6. not distribute information aimed at war propaganda, incitement of national, racial, or religious hatred or hostility, or any other information whose distribution entails criminal or administrative liability;
7. not disrupt the operation of the website;
8. not take actions aimed at misleading other Users;
9. not transfer the use of their account and/or account login and password to third parties;
10. not register an account on behalf of or instead of another person except where permitted by Russian law;
11. not post advertising, erotic, pornographic, or offensive material, or any other information whose publication is prohibited or contradicts applicable Russian law;
12. not use scripts or programs for automated collection of information and/or interaction with the Website and its Services.

7. Settlements Between the Parties

1. The cost of goods and services is determined at the discretion of the Website Administration.
2. The cost of goods and services does not include commissions charged by payment systems used for payment.
3. The User may top up the balance of their account on the website.
4. The User may use the balance to pay for goods or services offered on the website.
5. Payment for goods or services is made by the Customer on the basis of 100% advance payment.
6. The payment date is the date on which funds are received at the disposal of the Website Administration.
7. The Website Administration has the right, without giving reasons and without prior notice, to unilaterally change the cost of goods by publishing the new price on the Website.
8. The Website Administration has the right to set a minimum cost for a particular good.

8. Procedure for Ordering Services

1. On the website, the User selects a suitable plan, which is a package of a certain number of hours of play with companions of a certain experience level.
2. After paying for the plan, or the training package, the User’s balance is credited with the amount shown as the total in the plan information.
3. The User undertakes to use the balance only to pay for games within the training process and for the hours provided under the selected plan.
4. The Service undertakes to credit the User with the balance stated in the paid plan in the amount indicated at the time of payment.
5. The Service provides access to joint games with a Companion and does not guarantee that the result stated in the plan description will be achieved.
6. The completed service is a gaming session conducted with the Companion.
7. The processing center of aggregators that accept payments protects and processes your bank card data according to the highest international security standard, Payment Card Industry Data Security Standard 3.2 Level 1 (PCI DSS). This standard was developed by Visa and MasterCard. Information is transmitted to the payment gateway using TLS encryption and is then transmitted over closed banking networks with the highest level of reliability. Payment aggregators do not pass your card data to us or to other third parties. The 3D Secure protocol may be used for additional cardholder authentication. The personal information you provide, including your name, address, phone number, email, and credit card number, is confidential and not subject to disclosure. Your credit card data is transmitted only in encrypted form and is not stored on our server. If you have questions about a payment you made, you may contact the support service of the payment aggregator through which the payment was made.
8. You can pay for an order using Visa, MasterCard, and Mir bank cards, and you may list additional payment methods on your website if desired. To pay, you will be redirected to the Unitpay payment system server where you must enter the necessary details. For card payments, payment security is guaranteed by the Unitpay processing center. Unitpay has a valid PCI DSS compliance certificate for the storage, processing, and transmission of cardholder data. The PCI DSS bank card security standard is maintained by international payment systems, including MasterCard and Visa. Unitpay is also part of the PCI DSS Compliance Process (P.D.C.P.). Your confidential payment data, including card details and registration data, is not transmitted to the online store. It is processed on the Unitpay processing center side and is fully protected.

9. Receipt of Goods or Services

1. The User receives the goods or services in the form of one hour, or other specified period, spent together with the order performer.
2. The paid service is considered completed once the paid time has expired.

10. Refund Policy

1. Refunds to the User’s account balance on the website are made upon request submitted to support at https://egirlstime.com/help.
2. Withdrawal of funds is carried out upon request sent in free form to help@EgirlsTime.com. The request must include proof of payment, the User’s login, and the reason for the refund. The request is processed within up to 14 business days.

11. Liability of the Parties

1. Any authorized user bears full personal responsibility for the information they distribute.
2. The Administration bears no responsibility for the accuracy of information copied from other sources.
3. The Administration is not responsible for any mismatch between the services expected by the User and the services actually received.
4. The Administration bears no responsibility for services provided by third parties.
5. In the event of force majeure circumstances, such as military action, a state of emergency, natural disaster, and similar events, the Administration does not guarantee preservation of information posted by the User or uninterrupted operation of the information resource.

12. Validity of the Agreement

1. This Agreement enters into force upon any use of the website.
2. The Agreement ceases to apply when a new version appears.
3. The Administration reserves the right to unilaterally amend this Agreement at its own discretion.
4. When the Agreement is amended, in some cases the Administration may notify users in any manner it considers appropriate.

13. Legal Grounds for Processing Personal Data

1. The Operator processes the User’s personal data only if the User independently fills in and/or submits such data through special forms located on the website https://egirlstime.com/.
2. By completing the relevant forms and/or sending personal data to the Operator, the User expresses consent to this Policy.
3. The Operator processes anonymized User data where this is allowed in the User’s browser settings, including cookie storage and JavaScript use.
4. The website also collects and processes anonymized visitor data, including cookies, using internet statistics services such as Yandex.Metrica, Google Analytics, and others.
5. The security of personal data processed by the Operator is ensured through data encryption in a closed database.
6. The Operator ensures the safety of personal data and takes all possible measures to prevent unauthorized access.
7. The Operator is not responsible for actions and/or omissions of third parties that may result in the use of Users’ personal data.
8. If inaccuracies in personal data are identified, the User may update such data independently by sending notice to the Operator at help@e-girlz.com with the subject line “Personal Data Update”.
